  1. These Terms and Conditions (referred as the T&Cs) define the types, scope and conditions for the provision of services electronically by Meet Warsaw. Please carefully read the terms here – under as they define the conditions of access and use of the website. 
  2. Meet Warsaw is a brand of Varsavin Foundation, which is registered at the following address: 148 Górczewska st, app.1, 01460 Warsaw, Poland, with  TIN 522-300-92-94
  3. The terms defined below that are used in the T&Cs should be understood as follows:
    1. website – www.meetwarsaw.com, owned and managed by Varsavin Foundation
    2. user – a person using this website
    3. device – any device that can access the service e.g. a computer, a mobile phone, a digital tablet
    4. services – the functions,  applications, information, tours and other services accessible through this website
    5. material/s – any type of material or immaterial good which is rendered available through this website, e.g. merchandising products, drawings, images, photographs, illustrations, descriptions, informative texts, films, audio files (podcasts, music, sounds) and other accessorial programs
    6. content/s – messages, data, information, texts and other material including that of advertising nature
    7. third-party Social Media Service – any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the service
  4. In accessing or in any way using the website, the user agrees to comply by the T&Cs as well as to any of their subsequent modifications. When the user does not agree with T&Cs, including any subsequent modifications, he/she must not access or in any way use the website.
  5. This T&Cs shall be construed in accordance with the laws in Poland.
  6. The Website must not been used:
    • in any manner whatsoever in violation of the law
    • to cause harm to children in any way
    • to transmit or solicit the sending of any unsolicited advertising or promotional material (including in the form of spam)
    • to knowingly transmit any data or upload any material that contains trojans, viruses, spyware, adware or any other harmful program designed to adversely affect the operation of the Website or to harm another user.

7. The website is supported by all kinds of browsers. It does not require any special characteristics of the user’s device.

8. To conclude services offered by Meet Warsaw, a User must have an active e-mail account.

Intellectual property rights

  1. Meet Warsaw grants right of access to the website and to the materials contained within for non commercial and purely informative personal purposes. It means that the authorization of use of the website does not include the faculty of selling, commercializing, distributing the contents of the website or create works and/or materials derived from the website materials.
  2. The user acknowledges compliance and respect of all intellectual property rights of Meet Warsaw, relative to the materials.
  3. All the Materials of this Website are protected by the copyright defined by the expression „ALL RIGHTS ARE RESERVED” owned by Meet Warsaw and/or of third party licensees.
  4. No material can be copied, modified, reproduced, distributed, publicized, downloaded, rendered accessible to the public, diffused or transmitted in any form and through any means, without the prior consent of Meet Warsaw or with a clear indication of where it originated (link to the relevant part of the website) or with the exception of sharing on social media, where such a possibility is given.
  5. Meet Warsaw prohibits the uploading on the website of users materials such as e.g. music, software, images and any other materials which constitute a violation of the intellectual property rights of third parties, except for when the user has obtained the necessary authorizations.

Disclaimers and limitation of liability

  1. The Services are provided to You 'AS IS’ and 'AS AVAILABLE’ and with all faults and defects without warranty of any kind. Meet Warsaw expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Services, including all implied fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.
  2. Meet Warsaw provides no warranty or undertaking, and makes no representation of any kind that the Services will meet user’s requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
    1. During guided tours Meet Warsaw will not be liable for any theft, loss or damage private property of the User, and also delay, inconvenience, direct or consequential loss, however caused, unless due to negligence by Meet Warsaw, in which case our liability is limited (except for death or personal injury) for damages to a maximum of the refund of the tour price.
    2. During guided tours Meet Warsaw will not be liable in respect of loss or damage or changes caused by forces majeure events such as strikes, riots, fire, flood, natural disaster, weather problems or similar events beyond our control.
  3. Without limiting the foregoing, Meet Warsaw does’t make any representation or warranty of any kind, express or implied:
    1. as to the operation or availability of the Service, or the information, content, and materials or products included thereon
    2. that the Service will be uninterrupted or error-free
    3. as to the accuracy, reliability, or currency of any information or content provided through the Service
    4. that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
  4. Our website contains links to other websites. We cannot be responsible of any content hosted on these external websites, the privacy policy followed by those websites or any loss or damage you may suffer if you visit these external links.

Services

  1. The services accessible by this website are guided tours, newsletter, information about Warsaw, items offer in the shop.
  2. Guided tours inquiries are sent by User via contact form. The User is given an automatic answer immediately, and within 2 working days Meet Warsaw will answer at the e-mail indicated by the User. Every details of the tour are settled due to a mail contact between the user and Meet Warsaw.
    1. Booking a tour less than 24 hours before may not be realised, due to unavailability of the guide or driver. 
    2. The tours booked on Polish public holidays or at the last minute (less than 24 hours before) are charged +50% of the tour price to the total price. 
    3. Guided tours are provide by well-educated, English speaking guides.
    4. Transportation services are made by licensed drivers. Every car is in a good working order and has a valid test certificate. The drivers are  not tour guides and will not provide services of a guide.
    5. The guide and the driver  have the right to stop the tour or to exclude a participant if the participant behaves aggressively, is under the influence of alcohol or drugs. If the behaviour is dangerous for the surroundings, the tour guide or the driver have the right to call the police.
    6. The participant of the guided tour is ensured to obtain  adequate travel and medical insurance cover. Meet Warsaw do not provide any travel insurance.
  3. Newsletter is an information sent to the user on their request, to an indicated email address. Newsletter is sent at least one time in a month, with an information about Warsaw and other Services. The User can withdraw at any time by clicking a resignation link. 
  4. The shop provides items prepared by Meet Warsaw or third parties. Information about the purchase and return policy is located at selling page.

Payment

  1. The newsletter and informations about Warsaw at the website are free of charge.
  2. Guided tours are paid due to the type, the lenght, an amount of people and the type of transportation. The basic price, for Warsaw half day foot-tour (up to 4 hours) up to 5 people, is 450 pln.
  3. Purchasing items in the shop are described there.
  4. The total payment should be paid in advance. The prices are in Polish currency.
  5. Methods of payment depend on the item: by bank transfer, PayPal or payment card.
  6. Every payment will be issued by an invoice.

Cancellation and withdrawal

  1. You can withdraw the newsletter at any time by clicking the resignation link.
  2. Guided tours can be cancelled at any time, but resignation by the user 72 hours before the tour is charged 100% of the price. If the user resign more that 72 hours before the tour, full payment will be returned, minus the money transfer cost, if any. If the tour is cancelled by Meet Warsaw, the whole price will be returned for user.
    1. If the tour is interrupted by the guide or driver because of the unaccepted behaviour of a participant, the payment will not be refunded.
  3. The cancellation of the purchase in the shop is connected with the rules of third parties, if the item is provided by them (each time the adequate information is given before the purchase). 
  4. By purchasing the e-book or other online items, the user will receive access to the service immediately after payment. Therefore, he cannot be bound by the right to withdraw from the purchase after payment (as it is impossible not to consume the service to which immediate access has been granted). 

Complaints, pretence and resolution of disputes

  1. Complaints related to the use of the services on the website must be submitted by sending a message via contact form  or to the correspondence address indicated above.  Meet Warsaw shall respond to the User complaints within 30 days of their receipt. A response is given on paper or to the e-mail address indicated by the User.
  2. Any inappropriate or unsafe behaviour of guides or drivers should be reported immediately using the contact form and writing „cito” in the subject line of the message.
  3. In case of any pretence put forward, claims loss or damage (included legal fees) proposed by third parties which derives from the users conduct, he/she agrees to relieve and indemnify Meet Warsaw from any
    action of this kind.
  4. The dispute arising from Services may be of a consumer nature, and can be dealt in the light of applicable Polish law, or on the basis of the methods for out-of-court resolution of consumer disputes, or using an online system of resolution of disputes between consumers and entrepreneurs at EU level (ODR platform) in accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 (OJ L 165, 18.06.2013, p. 1).
